Arbeitsverhältnisse im Rahmen eines Betriebsübergangs: § 613a BGB und die Rechtsprechung des EuGH

For personnel managers, it is essential to be at least broadly informed about the current legal situation and to gain an understanding of the difficulties that arise during a business transfer. Since Section 613a of the German Civil Code (BGB) originates from European law or is based on the so-called Business Transfer Directive, the case law of the European Court of Justice (ECJ) is given significant importance in this area; knowledge of national case law from the Federal Labor Court (BAG) alone is not sufficient. For this reason, the author focuses on the effects of a business transfer on employment relationships from both a German and a European legal perspective.
