Shitstorm, media prejudice, disputes with customers: This book explores the labor law obligations that employers have when an employee is harmed in her personality by a third party outside the workplace. While the affected employee can take action against the third party herself, those affected are often overwhelmed or reluctant to bear the costs of civil legal proceedings. Therefore, it raises the question of whether employers must take protective measures for employees under Art. 328 of the Swiss Code of Obligations and how far such protective duties extend. In addition to covering legal fees, it could be particularly helpful if the employer can directly sue the offending third party. Whether this is permissible is also clarified in this work.
