Compliance means adhering to and following rules. It is required that the company, its bodies, and employees behave in accordance with applicable law. An appropriate organization of the company that ensures the legal compliance of employees is essential. Since the company can also be held liable if its workforce does not comply with the laws, corresponding control measures should be implemented within an efficient compliance organization to minimize liability risks. Under Austrian law, the personal rights of employees, the associated powers of the works council, and the obligations arising from data protection law must be taken into account. Austrian law establishes a high level of protection, which can conflict with the interests of the employer.
