The book addresses the duties and potential liabilities of the issuing and confirming banks when they decide not to pay against a documentary credit, as outlined in Article 16 (c-f) of the Uniform Rules for Documentary Credits, ICC Publication No. 600. While the obligation of the issuing and confirming banks to notify the presenter is clear, there are controversies regarding what constitutes a reasonable delay in notification. What is considered notification (oral notification or via telecommunication)? What should the notification consist of? What is deemed a reasonable delay for returning the documents to the presenter after the notification? These are some of the questions discussed in this publication.
