The Dual State by Ernst Fraenkel (1898-1975) is a standard work on politics, justice, and law in National Socialism. His thesis is that in National Socialism, two forms of rule coexist side by side: In the Norm State, existing legal provisions continue to apply to the extent necessary for the functioning of the still-existing capitalist economic system, while in the Measures State, decisions are made not according to legal rules but based on criteria of political expediency to secure the regime's power.
