Abtretungsmodelle im Zivilprozess

While one of the central legal policy discussions revolves around the extent to which Swiss civil procedural law should be supplemented by (genuine) instruments of collective legal protection, assignment models already offer a way to enforce similar claims in a bundled manner under current law. Experiences with litigation funding companies in Germany and particularly with the so-called collective action under Austrian law demonstrate that the model holds potential in certain configurations. Therefore, this dissertation is the first to examine, based on the characteristic elements of the assignment model, to what extent it can be utilized in Swiss civil procedure and what pitfalls need to be considered.
