On January 1, 2011, the Swiss Civil Procedure Code came into force, along with the new domestic arbitration law of Switzerland. Since then, parties to a contract who choose an arbitration tribunal based in Switzerland can opt-out to decide whether they want to subject their arbitration proceedings to Part 3 of the CPC or Chapter 12 of the PILA. This work addresses, on the one hand, the prerequisites and effects of an opt-out agreement. On the other hand, it extracts and contrasts the mandatory provisions of Part 3 of the CPC and Chapter 12 of the PILA. Therefore, this dissertation is aimed not only at those who wish to benefit from the opt-out options but also at all practitioners working with Swiss lex arbitri.
