The Supply Chain Due Diligence Act

The Supply Chain Due Diligence Act (Lieferkettensorgfaltspflichtengesetz - LkSG) requires companies to carry out extensive due diligence in their supply chains in order to prevent human rights violations and environmental damage. The implementation of the law presents companies with legal and organisational challenges. In her paper, Lena Herrmann provides an overview of the most important provisions of the LkSG. With reference to sources from the relevant literature and the legislative materials, she analyses the text of the law, discusses existing disputes and evaluates points of criticism. In addition, the author shows initial possibilities of how due diligence obligations can be integrated into company processes and contractual supplier relationships.
