Les grands principes de la procédure administrative

Les actes de la " Journée de droit administratif 2022 " font le point sur l'état aktuel des grands principes formels qui organisent et guident la procédure administrative et approfondissent la réflexion sur le rôle dans la mise en œuvre du droit administratif dans un État régi par le droit.

L'ouvrage traite d'abord du droit à la décision (y compris dans le domaine des actes matériels) et des aspects formels de la décision. It continues with an analysis of the right to be heard, of the impartiality and correct composition of the authorities and administrative jurisdictions, and of the power to examine the administrative jurisdictions. It then examines the obligation to cooperate and the hearing of the parties and witnesses, as well as the procedural rights independent of the quality of the party. It concludes with a general reflection on the evolution, the current state and the possible developments of the major principles of administrative procedure.
