Since time immemorial, the aim of legislation and jurisprudence has been to minimize the dangers arising from guarantees and to protect guarantors from their own inexperience, gullibility, good-heartedness, and excessive recklessness. In Switzerland, this protection is significantly more comprehensive than in the legal systems of other countries. This work systematically presents and explains all legal remedies that legislation and jurisprudence grant to a guarantor in Switzerland. Furthermore, it addresses current developments in guarantee law within domestic and foreign legislation and jurisprudence. The document concludes with considerations on how the complex and strict legal regulations regarding guarantees could be sensibly adjusted in the future.
