Kommentar zum Baugesetz des Kantons Aargau

The Aargau law on spatial development and construction (Construction Law) has been in effect since 1994. On March 10, 2009, it underwent a major revision. This prompted the author team to comprehensively comment on the Aargau Construction Law once again. The Construction Law regulates extensive areas of cantonal administrative law, such as spatial development, usage, construction and protection regulations, building permits, land consolidation, road law, water bodies, and expropriation. The courts and administrative authorities of the Canton of Aargau have developed a rich body of practice in this regard. The present commentary thoroughly examines the legislative materials as well as doctrine and case law. It also establishes the connection with federal legal requirements. The practices of other cantons are occasionally taken into account as well. Thus, this commentary proves to be a valuable publication for public construction law throughout Switzerland, extending beyond the cantonal framework of Aargau.
