New technologies raise new legal questions. But they also inspire us to rethink old questions. Inspired by the current discussion on liability for artificial intelligence systems, which - similar to humans and animals - are ascribed a certain 'autonomy', Ann-Kristin Mayrhofer discusses the topic of liability for third-party autonomy. She compares the non-contractual liability of business owners and animal keepers with the liability of manufacturers and users of 'technical agents' de lege lata . On this basis, the author makes proposals for a further development of liability law de lege ferenda . The focus is on dealing with the risks of injured parties not being able to enforce claims for damages, with particular attention being paid to difficulties of proof.
