Yes, you have to keep the button pressed down. It's much more practical than the Apple Remote.

The description does not say which generation of Apple TV 4K. The delivery note says 3rd generation. I own the 2nd generation. The remote control pairs and is connected, but then it no longer responds. Batteries are full.

We have enquired about this with the supplier and they have confirmed that it is Gen. 3. Unfortunately, we have not found any instructions from the manufacturer on what to do in the event of the problem you have described.
