No the two USB connectors are not the same distance apart on the Macbook and on the Surface Pro8 better something like this, available in different versions depending on the connections you need. Satechi ST-SCMA2M (1 x HDMI, 60 W, USB A, USB C)
Works for mine, but gets quite warm and the battery consumption is much higher than with the official one from Apple.
I have not tried with a MBP with M1. However, I have noted that the connection with a MBP or MB remains loose and I have to fiddle to make it good.

The adapter is probably broken according to what you described. If you bought the adapter less than 2 years ago, you still have warranty claims against Digitec. This means that you are entitled to have the adapter repaired or replaced by Digitec.
Have never used HDMI. Not satisfied with the technical design, bought one with cable instead of direct connectors. There were soon contact problems from moving the part around in daily use.

The two USB-C ports are 7 mm apart (measured on the inside). This might help to answer your question. Currently in use on a MacBook Pro.

Use the HUB on my MacBook Pro 2017. The two TB3 / USB-C ports on the MB Air (one below the other) have the same distances as on my MacBook Pro 2017, for example. Thus compatible.
Basically YES for external, HD's, sticks, HDMI cables, card readers... ATTENTION! Does not work with external CD/DVD burners, e.g. Apple Super Drive (https://www.digitec.ch/de/s1/product/apple-superdrive-laufwerk-dvd-externes-optisches-laufwerk-329014) which draws power from the computer. I don't think so, because the usbc slots are probably not placed in the same way.
